None of us knows when we will pass away or be placed in a position where we cannot make important decisions for ourselves. This is why we harp on the importance of estate planning and, at a minimum, having a legally valid Will to spell out how you wish to distribute your assets upon your death. Doing so reduces the likelihood that your family and friends will end up in an unnecessary and complex legal process during a time when they should be grieving.
Most people understand the significance of a Will. That is the good news. But what makes it a legally valid Will?
Is it as simple as creating a DIY Will with an online template? Could you or a loved one simply scribble a laundry list of final wishes on a McDonald’s napkin? A Last Will and Testament is considered legally valid if it meets certain requirements that can vary slightly from state to state or country to country.
Generally Speaking, a Will Is Legally Valid if …
- It is in writing (typed or printed) on paper
- Signed by the person making the Will
- Signatures are witnessed by two disinterested parties
- The person creating the Will is at least 18 and of sound mind
- Its intent is legally and clearly stated (to serve as the maker’s Will)
- The maker entered into it voluntarily and without coercion from others
- It is properly executed by a team of legal professionals
While you can create a Will online, many services that offer online wills are not law firms, cannot provide legal advice, or warn you of a potential mistake. Furthermore, the specifics of your online will may not hold up in court. This can make probate and other court matters incredibly complicated and financially costly. It is best to sit with a qualified estate planning attorney to ensure all these requirements are met, that there are no additional considerations to remember, and that your Will fully protects your family and stands the test of time.
Having a valid Will is about more than just checking legal boxes—it is about peace of mind. Whether you draft one on your own or work with an attorney, ensure it is a legally valid Will and meets Texas’ legal requirements.
That way, you can rest easy knowing your legacy is secure and your family will not be left in a lurch.
