How is custody determined?
Texas law states that child custody is based on the child’s best interests and does not give preference to gender. If you disagree about custody, the judge will evaluate many factors, including the stability of the environment each parent provides, the relationship between each parent and the child, as well as the emotional, physical, and financial health of each parent, along with many other factors. How is child support determined?
Under the Texas Child Support Guidelines, parents who net less than $9,200.00 per year, child support is generally a percentage of the non-custodial parent’s income (“net resources”), as follows:

- 3 children – 30% of the monthly net resources
- 4 children – 35% of the monthly net resources
