- Ask for clarification — It is OK if you do not know the answer to a question or what a word in a question means. Ask for clarification.
- Answer concisely — Stick to simple answers without volunteering extra information or filling silence with words.
- Avoid casual conversation — Do not engage in small talk with opposing counsel. You may inadvertently provide them information that could incriminate you or help the opposing party’s case.
- Don’t answer certain questions — Avoid answering questions about privileged or self-incriminating information. That said, use caution when invoking the Fifth Amendment. Discuss the implications with your lawyer.
- Manage your emotions — Stay composed rather than getting angry, upset, or frustrated.
- Take care of your body — Stay hydrated, well-rested, and take breaks.
- Bring only approved documents — Avoid bringing extra materials that could be examined by opposing counsel.
- Dress appropriately — Aim for conservative business attire to create a professional impression.
